Debt collection in Spain

Debt collection in Spain is quite a challenging process due to its unique legislative framework, complexities, and recent changes in the law. The process involves several legal aspects that both creditors and debtors need to understand.

Spanish law has a very comprehensive set of rules and regulations surrounding debt collection. The main legislation governing this area is the Ley de Enjuiciamiento Civil (Civil Procedure Act). This legislation sets out the procedures for debt collection, including the requirement for a legal proceeding for any debt above €2000. Also, the creditors need to follow a specific process, which includes sending a formal notice to the debtor before initiating any legal action. Additionally, it is illegal in Spain to hire private debt collection agencies that employ aggressive tactics or harassment to collect debts.

One of the significant challenges in Spanish debt collection is the bureaucratic process involved. The legal system can be slow, and it often takes a long time to get a court order to recover a debt. This can be particularly challenging for foreign creditors, as they may not be familiar with the Spanish legal system. Besides, the recent economic downturn has led to an increase in the number of bankruptcies, making it even harder for creditors to recover their money. In some cases, debtors may not have sufficient assets to cover the debt, making it almost impossible for the creditors to recover the entire amount.

The Spanish government has recently made some changes to the legislation to streamline the debt collection process and make it more efficient. These changes include allowing creditors to seize the bank accounts of debtors if a court order has been issued, without the need for any additional legal action. Also, the government has implemented measures to speed up the legal process, such as electronic notifications and online legal proceedings. These changes aim to make it easier for creditors to recover their debts while ensuring that the rights of the debtors are protected.
