Have you inherited an apartment or house in Spain but live in another country? In this situation, you need to deal with legal documents, inheritance taxes and property registration. Fortunately, many of these procedures can be completed without travelling to Spain.
Here is how foreigners can inherit property in Spain in 2026, which deadlines must be observed and what difficulties may arise.
Can Foreigners Inherit Property in Spain?
Yes. Foreign nationals can inherit property in Spain even if they are not Spanish residents.
However, when the deceased or their heirs lived in different countries, it is important to determine which country’s inheritance law applies.
Under EU rules, inheritance is generally governed by the law of the country where the deceased had their last habitual residence. In certain circumstances, a person may choose the law of their country of nationality in their will.
Therefore, inheriting an apartment in Barcelona does not automatically mean that Spanish inheritance law applies to the entire estate.

What Documents Are Required?
The exact requirements depend on the circumstances, but the following documents are commonly needed:
- Death certificate of the deceased.
- Will or documents establishing inheritance rights.
- Spanish Certificate of Last Wills (Certificado de รltimas Voluntades), where applicable.
- Heir’s passport and Spanish NIE/NIF identification number.
- Property ownership documents and cadastral details.
- Proof of family relationship, where required.
- Information about the property’s value, outstanding debts and other estate assets.
Foreign documents may require an apostille, legalisation and an official Spanish translation.
If the will was executed abroad, its validity and acceptance in Spain must be checked. If there is no will, the legal heirs must be formally identified.
Can You Inherit Property Without Travelling to Spain?
Yes. In many cases, inheritance procedures can be handled remotely through a legal representative with a power of attorney.
For example, a person living in the United Kingdom inherits an apartment in Barcelona. Instead of travelling to Spain to complete every formality, they may authorise a representative to handle the necessary procedures.
Depending on the powers granted, the representative can deal with the notary, submit documents, manage tax filings and arrange property registration.
A power of attorney may be issued at a Spanish consulate or before a notary abroad, subject to the applicable formal requirements.

It is important to define the representative’s authority carefully, particularly when the estate’s assets, debts and expenses have not yet been fully established.
What Taxes Apply to Inherited Property in Spain?
Inheriting an apartment or house in Spain may involve two main tax obligations.
1. Inheritance Tax โ Impuesto sobre Sucesiones y Donaciones (ISD)
The amount payable depends on the value of the inherited assets, the relationship between the deceased and the heir, the applicable regional tax rules and any available allowances or reductions.
In Catalonia, the property’s official reference value (valor de referencia), where available, may also affect the taxable value.
For non-resident heirs, determining which tax authority is responsible and which regional rules apply is particularly important.
For example, if an heir is not a Spanish tax resident, the inheritance tax return is generally administered by the Spanish Tax Agency (Agencia Tributaria, or AEAT), even when the inherited apartment is located in Catalonia. Regional tax provisions may still apply in certain circumstances.
2. Municipal Capital Gains Tax โ Plusvalรญa Municipal
This tax may arise when inheriting urban property. It relates to the increase in the value of the land, and its calculation depends on the applicable legislation and local municipal rules.
As a result, inheritance costs cannot be estimated solely from the property’s market price. It is advisable to calculate the potential tax liabilities before completing the inheritance process.
How Much Time Do You Have to Settle an Inheritance?
This is one of the most important issues for foreign heirs.
The standard deadline for filing an inheritance tax return is six months from the date of death.
In Catalonia, an additional six-month extension may be requested, but the application must be submitted within the first five months after death. Interest may apply during the extension period.
The municipal plusvalรญa tax generally has a six-month filing deadline for inherited urban property, with the possibility of an extension of up to one year upon request.
These tax deadlines should not be confused with the time required to complete notarial procedures or register the property.
Even if the heirs are still collecting documents or agreeing on how to divide the estate, tax obligations may already be due.
Missing the deadlines can result in additional costs and complications.
How Is Inherited Property Registered in Spain?
The inheritance process generally involves several stages:
- Verification of inheritance rights. Confirming whether a will exists, identifying the heirs, determining the applicable law and reviewing the estate’s assets.
- Document preparation. Obtaining the necessary certificates, identification numbers and property records.
- Acceptance and distribution of the inheritance. Preparing the documents required to transfer the inherited assets to the heirs.
- Tax compliance. Filing the relevant tax returns and fulfilling applicable tax obligations.
- Property registration. Registering the transfer of ownership with the Spanish Land Registry (Registro de la Propiedad).
If several heirs are involved, they must also agree on how the property will be distributed. Disagreements can significantly increase the time and cost of the process.
Before accepting an inheritance, it is also important to investigate potential debts.
Depending on the applicable law, heirs may have options to limit their liability, but specific legal requirements must be met.
